Second MN City Considers Anti 2A Action

Edina is a suburb which borders Minneapolis. They’re following St. Paul’s lead. Edina’s city council at the October 22nd meeting ordered the drawing up anti 2A ordinance and resolution proposals, which they will consider at their November 18th meeting.

As you can see, the council’s anti 2A wish list includes,

It’s a pretty standard wish list for the anti’s in 2025. This resolution is the one they refer to, here in their October 22nd meeting. The relevant portion of the meeting begins at, 1hr and 52min, and ends at 2hr and 35min. It’s painful to sit through. So I’ll summarize below.

  1. They all know the city will be sued if they pass an ordinance, though, they somehow think a stand alone “safe storage ordinance” would not violate state preemption (including city attorney), I’m unclear how they came to that conclusion. The ordinance they want to pass they want it based off the resolution I showed above, and they want to look at St. Paul’s proposed ordinance as well (Council member Julie Risser appears on the fence about passing ordinances)
  2. Everyone wants to “do something”, “pass something”, “let’s just do it”, etc, though a council member, Julie Risser expressed the desire to take a “pragmatic approach”.
  3. The mayor, Jim Hovland equated Edina passing an ordinance which violates state preemption law to “jury nullification”. He was also seemed to get confused on binary triggers versus conversion devices.
  4. The city attorney David Kendall cautioned the council, warning of state preemption law, the council didn’t seem to care, with possible exception to Risser. He then back tracked later on, and came around to passing anti 2A ordinances. Again earlier he thought a “safe storage ordinance” would not violate preemption.
  5. The city manager, Scott Neal, clearly is anti 2A, though he cautioned city ordinance(s) could put police officers in legal jeopardy and cause some to lose their license. That didn’t cause much discussion.
  6. The city manager also said the city has been working with their “legislative team” to push for the measures laid out in the above resolution to be passed by the legislature.
  7. The mayor, wants to pass ordinances which would go into effect after state preemption is repealed.
  8. They want to read proposed ordinances, and resolutions that staff will draw up and go over them at next meeting, Novemeber 18th.
  9. It was interesting to see the mind set. They all know they will be challenged, but are angry that the state legislature hasn’t taken action and believe violating state preemption will help force the state to either pass anti 2A “laws” or repeal the preemption law so cities can pass anti 2A ordinances. Their rational is Trump’s violating the law and getting sued so they can too.
  10. Over half of those in attendance appeared to wear Moms Demand Action shirts. Unsure of exact number.
  11. At no point was there any mention of legal bills, if they pass ordinance(s) and get sued.
  12. And no one uttered the words, the Second Amendment.

The MN Gun Owners Caucus is on the ball and sent the Edina city council a letter, which you can read, here. It’s because of things like this that I encourage everyone to look at their state association(s) and consider joining if they’re doing good work. I like what MN Gun Owners Caucus has been doing lately, and I’m a member. While it’s tempting to stay focused on what’s happening in Congress, we can’t forget to pay attention to what’s happening in our own backyards.

Update, from MN Gun Owners Caucus, “If a city passes an ordinance it knows to be preempted, that may give rise to litigation. If so, it will take staff time and taxpayer dollars to defend the lawsuit. Cities can accomplish the same goal by passing a resolution…”
