They say, “The most likely probability is that the Brewer firm is looking for NRA to pick up the tab, under a nonprofit’s power to “indemnify” its officers and directors. If that is their hope, they face some big obstacles.”
Now, the issue with that is, Tom King is not in fact an officer or director of the National Rifle Association of America (New York charter). He was, yes, a director but lost in the recent elections. Does that matter to the case and NY non profit law, as this case was filed prior to NRA Annual Meeting? Would the law still apply, because the suit was filed while King was still on the BoD?
NRA IN DANGER lists some issues with that too, citing the NY non profit laws. They are right, problems…
Also, NRA Foundation is chartered in Washington D.C., not New York, so, would D.C. non profit law apply here? It would seem to, if Foundation wanted to pay for King’s legal bills. He is the Foundation’s current and long time chairman.
King’s also still president of NRA’s New York association, the New York State Rifle And Pistol Association. Would they try to pay? If they did, then surely NY non profit law would apply.
Or would another NRA entity try to pay? Whittington? Political Victory Fund? Civil Rights Defense Fund? Freedom Action Foundation? Am I forgetting any?
